Best of Sephora Fan Favorite Contest
Official Rules

1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT AFFECT OR IMPROVE THE CHANCES OF WINNING. Contest is subject to all applicable laws and regulations. Void where prohibited or restricted by law.
2. Sponsor: Sephora USA, Inc., 525 Market Street, 32nd Floor, San Francisco, CA 94105 (“Sephora” or the “Sponsor”).
3. Eligibility: Contest is open only to legal residents of the United States (excluding Arizona, Puerto Rico, Guam and all other U.S. and foreign territories and possessions) who are at least 18 years of age as of the date of entry. Contest is not open to employees, independent contractors, officers, directors or agents of Sponsor or any of Sponsor’s parents, affiliates, subsidiaries, successors and/or assigns, Sponsor’s advertising, promotion and fulfillment agencies, and legal advisors, and the immediate family members (mother, father, brother, sister, daughter, son or spouse, regardless of where they live) and persons living in the same household (whether or not related) of any of the foregoing (collectively, “Contest Entities”).
4. Entry Method: To enter, post your entry with your prediction of the Winning Product (defined below), why you love the Winning Product and your email address (collectively, your “Contest Submission”) as a comment to the May 30, 2008 post on the Sephora Beauty & the Blog site (at http://blog.sephora.com). The Winning Product will be the product that receives the greatest number of write-in votes in the “Beauty Addict’s fave” write-in category in Sephora’s Best of Sephora 2008 Sweepstakes. The Winning Product must be a product currently carried by Sephora in its stores or through its website. In the event multiple products receive the same number of write-in votes, Sephora shall select the Winning Product from such products in its sole discretion. Only one entry per person. Use of multiple email addresses to enter is prohibited.
5. Ownership and Use of Contest Submissions: All Contest Submissions become the property of Sephora, and will not be acknowledged or returned. Your Contest Submission will be posted on the Sephora Beauty & the Blog site. Any information submitted as part of your Contest Submission will not be treated as confidential, proprietary or trade secret information and, by submitting such information, you are granting Sephora an irrevocable and unrestricted license to use, modify, reproduce, transmit, display and distribute such information for any purpose whatsoever.
6. Content Restrictions: Your Contest Submission must not contain or reference any of the following:
• Lewd, vulgar, indecent or obscene language or material (as determined in Sephora’s sole discretion);
• Material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights;
• Material that is copyrighted, trademarked, protected by trade secret or otherwise subject to a third party’s proprietary rights, including privacy and publicity rights, unless you are the owner of such rights;
• Defamatory, offensive, threatening or harassing statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group);
• Material that violates any law, statute, ordinance or regulation.

Sephora may, in its sole discretion, disqualify any Contest Submission that does not comply with these content restrictions or that Sephora otherwise deem to be inappropriate in its sole discretion. In the event of disqualification, the Contest Submission will not be judged or considered for a prize, and your entry will be removed from the site.
7. Contest Period: The Contest begins on May 30, 2008 at 5:00 p.m. Pacific Time (“PT”) and ends June 18, 2008 at 5:00 p.m. PT. Sponsor is not responsible for lost, late, incomplete, or illegible entries. Incomplete information may result in disqualification of entry.
8. Winner Selection: Ten (10) winners will be selected by random drawing from the entrants that correctly predict the Winning Product. If less than ten (10) entrants correctly predict the Winning Product, then (a) each of those entrants who correctly predicted the Winning Product will be selected as a winner, and (b) the remaining winners will be selected by a random drawing from all of the remaining entrants. Winners will be selected on or about August 25, 2008 and will be notified by e-mail. Odds of winning depend on the total number of eligible entries received and the number of entries predicting the Winning Product.
9. Prize: Ten (10) winners will be awarded the Winning Product. The retail value of the prize depends on the Winning Product; the approximate retail value of the prize based on the average value of all Sephora products is $45. Prizes are non-refundable and non-transferable, cannot be combined with any other special offer or promotion and must be accepted as awarded. Prizes may not be exchanged for cash value or substituted, except that Sponsor reserves the right in its sole discretion to substitute with either the cash value of the applicable prize that would otherwise have been awarded, or a prize or prizes of equal or greater value. Applicable federal, state, or local taxes and any other costs or expenses associated with the prizes are the sole responsibility of the winner. There will be no other prizes. Total approximate retail value of all prizes is $450 (based on the average value of all Sephora products). Prizes will be delivered to confirmed winners.
10. By participating, each entrant agrees to comply with these official rules and that Sponsor is not responsible for any incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error that may occur in the processing of submissions in the Contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of, the web site or any technical failure or malfunction.
IN NO EVENT WILL THE SPONSOR OR ANY CONTEST ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE ENTRANT’S PARTICIPATION IN THE CONTEST, ANY PRIZES WON, THE ENTRANT’S ACCESS TO OR USE OF ANY OF THE SPONSOR’S WEB SITES, OR THE ACCESSING, DOWNLOADING AND/OR PRINTING OF ANY MATERIAL AVAILABLE ON SAID SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SPONSOR’S WEB SITES IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSIONS OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO THE ENTRANT.
11. By accepting a Contest’s prize, the winner, where permitted by law, grant (and agree to confirm that grant in writing at the Sponsor’s request) to Sponsor the right to use and publish his/her name, address, Contest Submission, portrait, picture, voice and likeness for advertising, trade and promotional purposes without notification, review or approval, and without additional consideration, worldwide and on the Internet. The winner may be required to complete, sign and return an affidavit of eligibility and/or a liability/publicity release, which must be returned within seven (7) days from the date of notification. Failure to sign and return such documents timely, or if prize or prize notification is returned as non-deliverable, or if winner is found to be ineligible or otherwise not in compliance with these official rules, prize will be forfeited and awarded to an alternate winner in Sponsor’s sole discretion in accordance with these official rules.
BY ACCEPTING A PRIZE, THE WINNER RELEASES AND AGREES TO INDEMNIFY AND HOLD HARMLESS SPONSOR AND ALL CONTEST ENTITIES FROM ANY AND ALL LIABILITY FOR ANY INJURY, LOSS OR DAMAGE OF ANY KIND TO PERSONS, INCLUDING DEATH, AND PROPERTY, ARISING FROM OR IN CONNECTION WITH ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, PARTICIPATION IN THIS CONTEST OR ANY CONTEST-RELATED ACTIVITY.
12. If, for any reason, the Contest is not capable of running as planned because of circumstances including, but not limited to, unauthorized intervention, fraud, technical failures, or any other causes, which, in the Sponsor’s sole judgment, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, in its sole discretion and determination of fairness, to cancel, terminate, modify or suspend the Contest and to select a winner from entries received prior to such action, in accordance with these official rules. Sponsor may disqualify any entrant who tampers with the entry process, operation of the Contest, or violates these official rules.
13. By registering to enter the Contest, each entrant acknowledges he/she has read, understands and will abide by these official rules. All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, or the rights and obligations of entrants and/or Sponsor in connection with the Contest, shall be governed by and construed in accordance with, the laws of the State of California, without regard to the conflict of laws principles.
14. For a list of names of winners, send a self-addressed stamped envelope for receipt by January 31, 2009 to: “Best of Sephora Fan Favorite Contest,” Sephora USA, Inc., 525 Market Street, 32nd Floor, San Francisco CA 94105. Vermont residents may exclude stamp on return envelope.
15. The personal information collected from each entrant in the course of the Contest will be used by Sephora for the purposes of administration of the Contest and as otherwise permitted in accordance with Sephora's Privacy Policy.
